1. Definitions
- "Firm", "we", "us", "our" refers to Pusaka Cendana, a legal practice registered in Malaysia.
- "Services" refers to estate administration, will drafting, estate planning review and legal consultation provided by the Firm.
- "Client", "you", "your" refers to any person who contacts the Firm, uses this website, or engages the Firm's services.
- "Website" refers to the Firm's website at pusakac.pro.
- "Agreement" refers to these Terms and Conditions, together with any written engagement letter or fee agreement entered into with a client.
- "Content" refers to all text, materials and information on the Website.
2. Acceptance of Terms
By accessing this Website or contacting the Firm, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. Use of this Website and engagement of the Firm's services constitutes acceptance of these Terms. If you do not agree, please do not use the Website or contact the Firm for services.
3. Services
Pusaka Cendana provides legal services in Malaysia relating to estate administration, will preparation, estate planning review and initial estate consultation. All services are provided by or under the supervision of lawyers registered with the Malaysian Bar. The Firm reserves the right to decline instructions at its discretion, including where a conflict of interest exists or where the matter falls outside the Firm's area of practice.
The Firm's services are available to clients based in or with estate matters connected to Malaysia. Geographic or legal restrictions may apply in certain circumstances.
4. Engagement and Fees
A formal engagement begins when a written instruction or fee agreement is accepted by both parties. The fee for each service is stated at the outset of engagement and will not be varied without prior written agreement. Fees for services available through this website are as follows:
- Initial Estate Consultation: RM 175
- Will Drafting and Estate Planning Review: from RM 430
- Complete Estate Administration: from RM 645
Fees stated are in Malaysian Ringgit (RM). Disbursements (court fees, stamp duties, land registry charges) are payable separately and will be disclosed in advance. Payment terms are set out in the engagement letter.
5. Client Responsibilities
Clients are responsible for providing accurate, complete and timely information and documentation required for the conduct of their matter. The Firm accepts no liability for delays or adverse outcomes arising from incomplete or incorrect information provided by the client. Clients must not use the Firm's services for any purpose that is unlawful or contrary to the rules and ethics of the Malaysian Bar.
6. Website Use
The Content on this Website is provided for general information purposes only and does not constitute legal advice. No solicitor-client relationship is formed by use of the Website alone. Visitors must not reproduce, distribute or commercially exploit Content without prior written consent from the Firm.
You must not use the Website to transmit harmful, illegal or offensive material, or to attempt to gain unauthorised access to any system or data.
7. Intellectual Property
All content, design and materials on this Website are the intellectual property of Pusaka Cendana unless otherwise stated. You are granted a limited, non-exclusive, non-transferable licence to access and view the Website for personal, non-commercial purposes. Nothing in these Terms transfers any intellectual property rights to you.
8. Confidentiality
All information provided in the course of a legal engagement is subject to solicitor-client privilege and is held in strict confidence. The Firm will not disclose client information to third parties except as required by law, as necessary to conduct the engagement, or with the client's written consent.
9. Disclaimers
The Website and its Content are provided on an "as is" basis. While the Firm takes reasonable care to ensure accuracy, no warranties are made as to the completeness or currency of information on the Website. The Firm is not liable for any loss arising from reliance on Website content without formal legal advice.
10. Limitation of Liability
The Firm's liability in connection with the provision of legal services is limited as set out in the engagement letter. To the extent permitted by Malaysian law, the Firm is not liable for indirect, consequential or incidental losses. Nothing in these Terms limits liability for fraud, wilful misconduct or death or personal injury caused by negligence.
11. Termination
Either party may terminate the engagement by giving reasonable written notice. The Firm may cease acting where there is a conflict of interest, failure to provide instructions or information, or non-payment of fees. Upon termination, all outstanding fees for work completed are payable. Files and documents will be returned or transferred as directed, subject to any lien for unpaid fees.
12. Governing Law and Dispute Resolution
These Terms and any engagement between the Firm and a client are governed by the laws of Malaysia. In the event of a dispute, the parties will attempt to resolve the matter through negotiation in the first instance. Where negotiation fails, disputes will be submitted to the jurisdiction of the courts of Malaysia, with Kuala Lumpur as the agreed seat. Clients are also entitled to refer complaints about solicitors' conduct to the Malaysian Bar's Disciplinary Board.
13. Changes to These Terms
The Firm may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Website following any update constitutes acceptance of the revised Terms.
